GAOL SENTENCE TO STAND

An appeal by William James Banks (Mr. W. W. King) against conviction by Mr. J. H. Luxford, S.M., on a charge of theft of two hams from his employer, the Hydra Bacon and Meat Company, Limited, and sentence of six weeks' imprisonment was heard by Mr. Justice Fair today. Mr. V. R. Meredith, for tlie police, opposed the appeal. After evidence showing that the appellant was found thi-ovving a ham oat of a window of the factory, the appellant gave evidence that at the time he was in a state of intoxication and, was not aware of what he was doing. His Honor affirmed the magistrate's conviction, rejecting the view that appellant was unaware of • the quality of his action. The sentence also was affirmed, his Honor remark-j ing that it had been imposed by an experienced magistrate. I
