JURY UNABLE TO DECIDE

P.A. CHRISTCHURCH, Wednesday

After a retirement of more than four hours the jury failed to agree in the case of Edward Smith, farm labourer, who pleaded not guilty before Mr. Justice Northcroft to a charge of negligently driving a motor car so as to cause the death of a 16-year-old cyclist, Hori George Norton. The charge arose out of an accident at an intersection. For the defence, Mr. C. S. Thomas said it was admitted that Norton was killed by a car driven by accused. The jury had to decide, however, whether the Crown had proved that Smith's negligence had caused the accident. The foreman of the jury said there was no likelihood of agreement being reached. Application for a new trial was granted.
