FARMERS' CLAIM

Contending that sewage from the Fcilding saleyards had polluted the Makino Stream, which adjoins his property, thereby injuriously affecting his stock. Arthur Read, dairy farmer, is seeking £8/4 damages in the Supreme Court before the Chief Justice. Sir Michael Myers, from the Manawatu Live Stock Auctioneers' Association. An injunction restraining the defendants from further polluting the stream was also sought. Lengthy evidence was heard, in which the importance of the saleyards to Feilding was pointed out. After evidence for the plaintiff. Mr. Cooper, counsel for the defendants, intimated that a scheme was now being considered for an alternative disposal of the sewage or the shifting of the yards. He indicated thai he" would consent to the injunction, but proceeded to call evidence on the aspect of the damages. An injunction was granted, but to lie in Court six months to give the auctioneering firms time to abate the nuisance. Read was granted a lump sum of 1325 to cover loss of produc- ! tion through stock refusing to drink I the polluted stream water and the cost of laying down an artesian well.
