IN FIRST DIVISION

ONE MAN SENT TO GAOL

Charged with failing to enrol in the P'irst Division of the Reserve, five men were prosecuted in the Police Court this morning. Two. who enrolled late, were each fined £° and costs, while another who deceived a firm by producing his brother's registration card was sent to prison. Two of the other men charged failed to appear. «nd the magistrate. Mr. K. K. Hunt, issued warrants-for their arrest. Hector H. Capil pleaded guilty to a charge of failing to enrol. Senior Sergeant Joyce said C apu was 34 and a barman. He said he tilled in a form and posted it and received no confirmation. He enrolled in March —it was a late enrolment."' added Mr. Joyce. Mr. Bruce Elliott, who appeared for Capil. said the trouble was caused by Capil not reading the form correctly.

posed. • This is another late enrolment, said Senior Sergeant Joyce concerning "U'eslev F. Xorris. who also pleaded cuiltv. "He enrolled on March 31. He savs he was busv and did not like to lose any time off to enrol." Xorris. too. was fined £2 and costs. The names of two other men were called but neither appeared. Respecting one of them. Senior Sergeant Joyce said the defendant was very defiant and had refused on throe occasions to report. Tn both cases the magistrate ordered warrants to be issued for arrest. Produced Brother's <"ard In the case of Phillip C. Hartland. who pleaded guiltv. Senior Sergeant .lovce said Hartland filled in a form but did not post it. When he went to work at the New Zealand Glassworks the firm demanded Hart land's registration certificate. Hartland produced his brother's card and as a result of his deception the firm was being prosecuted for employing an unregistered person. Hartland had since enrolled.

"This is a different case." said the magistrate, in sentencing Hartland to 14 days' imprisonment. The magistrate dismissed the charge brought against the New Zealand Glass Company. Limited. Similarly charged. Nelson S. Fraser pleaded guilty.

Senior Sergeant Joyce said Fraser asked Capil for his enrolment certificate and Capil produced something which Fraser did not examine properly. It was not the proper certificate. It was pointed out hv Mr. Elliott, who appeared for defendant, that Fraser made full inquiries and demanded Capil's certificate. He accepted Capil's word that he had enrolled. Fraser was fined CI and costs.
