FRUITERER'S POSITION.

APPEAL OX TWO GROUNDS

Undue hardship and public interest were the grounds of an appeal by Roxford Ah Chee, a Remuera fruiterer for whom Mr. Horrocks appeared at the Auckland Area Manpower Committee yesterday, but the committee was not convinced that, even if the appellant's shop had to be closed, the appellant was entitled to succeed on those grounds.

The people living at Remuera would not have to go without their fruit or vegetables because this reservist was undergoing territorial training," remarked the chairman, Mr. I. J. Goldstine. "It is no use saying that the public interest is at stake." The committee dismissed the appeal on that ground.

On the question of undue hardship it was found that the reservist's brother-employed in the same shop was undertaking territorial training immediately, and the committee deferred further hearing of the appeal until June, requiring the reservist to satisfy the committee at the next hearing as to the steps taken to enable him to undertake training
