CHARGE AGAINST PAINTER.
When Cecil William Hutchineon (32), a painter, appeared in the Police Court this morninz charged with being in a state of intoxication in charge of a motor car in Poneonby Road on March 30, Kenior-Sergeant Calwell explained to Air. J. Atorling, S.AI., that defendant had failed to appear in anewer to his bail on Saturday morning. The presiding justices of the peace had issued a warrant for his arrest, and he (Mr. Calwell) had made formal application that defendant be required to eetreat hie recognisance. Mr. K. Aeklns, for defendant, eaid that defendant was correct in his surmise that the. case would not be heard on Saturday, and he was suffering from a complaint which confined him to his bed. In applying for a renewal of bail, counsel suggested that a condition of bail might be that he must report to the police. In reply to the magistrate defendant said he could not appear as he could not etaml up or sit down. He had to lie on hie face all day. I Finally Mr. Moiling remanded dej fendant till April 8. Bail was allowed . in defendant's own recognisance of foO, I and it waa stipulated that he mnet report to the police daily. The question i of the forfeiture of bail could be con- ■ sidered later.
