INTERPRETATION OF WILL.
Six parties were represented in. the»js Supreme Court this morning, before Mr.- g Justice Fair, at the hearing of an origin- :H ating summons in which the plaintiff 1 was Mary Wallace Kidd and the defend- -' ant was the New Zealand Insurance • Company Limited. The hearing arose in connection with the will of the late William Wallace " Kidd, of Auckland, whose estate wm vgj valued at £17,000. In his will, which;, he drew up himself, deceased made pro-"i*3 vision for his wife and daughter. Ig9 was provided that on the death of his |L" widow the net income should go to Mi 7: daughter, and that in the event of the daughters death, without issue, the IS whole of the income should go to the m Auckland Grammar School Board to « provide prizes. Mr. Hubble appeared for plaintiff; ;-, Mr. Butler for the widow; Mr. Spence|g for the defendant; and Mr. Weir for , ; s the Auckland Grammar School Board. | Mr. Valoux and Mr. Finlay appeared 1 on behalf of other parties. It was announced that counsel had -;j discussed the matter amicably, that a || deed had been drawn up, and the Court : was asked to approve it. His Honor said that difficulties had ■-■' arisen, through testator drawing up his ,-: own will, and it did not express con-Ha cisely his intentions. His Honor approved the amended deed and made an order accordingly.
