PRISONERS SENTENCED.
TERMS OF PROBATION.
Committed from the Magistrate's Courts at Kaikohe and Waihi, four prisoners came before Mr. Justice Fair in the Supreme Court to-day for sentence.
A Maori youth, Jack Court (19), on a charge of unlawful carnal knowledge at Kaikohe, put in a plea for probation, assuring hie Honor that he would not offend again. His Honor observed that normally the Court did not extend probation for such offences, but there were special extenuating circumstances in this case, which had been reported by the probation officer. Aβ a consequence, the prisoner would be admitted to probation for two years, one of the conditions being that he should repay £4 15/9, costs of prosecution.
On charges of breaking, entering and theft at Waihi, three prisoners, John James Kelly (21), Aylmer Tuddenham (28) and Arthur Lawrence Mudgway (25), had nothing to say in mitigation of the offences, but the probation officer reported favourably on their character generally and previous conduct. Hie Honor said *hat he had noted that the offences were committed while the men were under the influence of drink, and while he had decided to admit them to probation for a. period .of two years, Kelly and Mudgway would be required to take out prohibition orders against themselves for that period. They were also required to pay 28/3 coete within three weeks, while Tuddenham was ordered to pay 42/ coete within the same. time.
