UNION NONSUITED.
CLAIM AGAINST COMPANY.

In the Magistrate's Court yesterday the Auckland Drivers and Related Trades' Industrial Union of Workers, represented by Mr. Owen R. Thomas, claimed to recover from Transport, Limited, a penalty of £500 for an alleged breach of award. A preliminary objection was made by Mr. Gray, of Auckland, representing the defendant company, who pointed out that the proceedings had been brought by the Auckland union, which was not a party to the award. Counsel submitted that the award was made between the New Zealand union and various employers, all of whom were described as parties, and contended that the plaintiff union had no claim whatever and that the proceedings were not properly before the Court. Mr. Thomas, in reply, claimed that the Auckland union was affiliated with the New Zealand union and therefore could rightly bring proceedings.
The magistrate, Mr. J. G. L. Hewitt, upheld Mr. Gray's objection and nonsuited the plaintiff union.
Another action brought by three exemployees of Transport, Limited, for recovery of alleged short-paid wages was also heard, judgment being given for the defendant company. Mr. Thomas gave notice of appeal in all the cases.
