TRESPASS ALLEGED.
REMOVAL OF TREES. DETECTIVE BRINGS ACTION. £135 DAMAGES SOUGHT. Well known as a detective-sergeant of police in Auckland, Andrew Gilbride McHugh (Mr. Moody) was the plaintiff in a damages claim heard in the Magistrate's Court to-day before Mr. W. R. McTvean, S.M. Defendants were W. L. Wiseman, solicitor, of Auckland, and Dominion Park Estate, Limited, Rotorua (Mr. Richmond).
Plaintiff, in hie statement of claim, alleged that the defendants on or about May 10, 1930, and on subsequent dates, had wrongfully entered and trespassed on his land in Pah Road, Onehunga, and had cut and removed 13 pinus insignis trees growing on the boundaries, and had sold the timber. Plaintiff claimed £10 damages for estimated cost of repairing fences, £25 for the estimated cost of stumping the trees, and £100 general damages for alleged wrongful trespass and depreciation in value of the land. Tt was stated in evidence that the defendant company had received £8 or £9 from the sale of the timber. The defendant company admitted liability for the amount received for the trees,, and said it was willing to pay that amount. The other defendant denied liability, as, it was claimed, he was. purely an agent. James Alexander Lamb,' timber merchant, called by Mr. Moody, said the removal of the 13 shelter irees had decreased the value of the land.
