CLAIM FOR DAMAGES

An accident at Takapuna la*>t June when a dairyman, John Herbert Teasdale, was knocked down by a motor ear driven by Mrs. Phoebe Matilda Lewin (Mr. North), was the subject of a claim for damages heard in the Supreme Court before Mr. Justice Callan and a jury of four. Teasdale, who was represented by Mr. R. P. Hunt, contended the accident was due to the negligence *of the motorist and claimed £175 general and £30 special damages. The plaintiff, in evidence, stated that he had gone off the left side of the footpath in Huretmere Road to speak to someone in a motor oar when he was struck. The defendant said that she noticed plaintiff start to walk diagonally acroM the road. Near the centre he turned round and walked in the opposite direction. She was then about 15 feet from him. Plaintiff was hit by the extreme right of the front mudguard. In addressing the jury hi* Honor said that if any negligence of the plaintiff contributed to the accident then he could not succeed. The jury retired to consider it« verdict shortly before 1 p.m.
