HABEAS CORPUS.
YOUNG MAN'S SENTENCE. PROCEDURE CHALLENGED. Decision was reserved by Mr. Justice Fair and Mr. Justice Callan on the application for a writ of habeas corpus heard in the Supreme Court in respect of Phillip Donald Martinovich. (Mr. Hall Skelton), aged 21. The prisoner was sentenced on May 28 last to two years' reformative detention following a conviction in the Police Court for the theft of a suit length. A few days prior to that conviction he had been released on two years' probation in connection with a charge of obtaining credit by fraud and of uttering a forged cheque. It was contended that the warrant of committal was defective, and that the wrong procedure had been adopted in sentencing Martinovich on the original charge.
For the gaolor Mr. Hubble submitted that when Martinovich did not obey the Court's order in respect to his probation license it was concelled, and he cams before the Court again on the original charge.
The Court reserved its decision and prisoner was remanded in custodv.
