LOSS OF FOUR FINGERS.
BUTCHER TO PAY £100. Judgment for £100, .with costs, £25, was entered by the Arbitration Court this morning for Donald Franklin Barber, butcher's ' assistant, of Whangarei, who through his guardian, Benjamin Richard Barber, claimed compensation from his employer, 'Charles Hauptmann Finlayson, also of Whangarei, in respect of an accident , which befell him .on December 18 last. ; ' ■
Plaintiff, a'minor,, who attained, the age of 17 years on January 28 last, was receiving £1 a week at the time.of :the accident. On December 18, 1934, he got his left hand caught in a mincing machine and as a result lost four fingers.
In the statement of defence it was alleged that, the plaintiff removed or interfered with the guard supplied by the defendant for use in operating the mincing machine and his actions constituted serious and wilful misconduct, disentitling him to recover any sum.
Mr. J. Hore, for the defendant, announced to the Court that a settlement had been arrived at, the defendant agreeing to pay plaintiff £100, with costs, entirely without prejudice.
Mr. B. Ellwarth, for the plaintiff, said the settlement was an eminently satisfactory one from the point of view of plaintiff. The plaintiff would be at a disadvantage on the labour market, and his father was endeavouring to establish him in a business.
