INSURANCE EXEMPTION CASE.
WELLINGTON, Friday.
Conditional leave to appeal to the Privy Council in the case Lyon versus the Public Trustee was granted by the Court of Appeal to-day. Tlio Supreme Court was first asked to decide whether the provisions of the Life Insurance Act, which exeinpetd the prqeeeds of a policy or policies up to £2000 from the payment of debts, applied to the proceeds of a policy taken out by ' the. deceased, George Dou°las Lyon, in Scotland, before he came to New Zealand. Mr. Justice Ostler held that the proceeds of the policy were not exempt, and that the New Zealand legislation did not cover them. This decision was reversed by the Court of Appeal, and an application was now made to appeal to the Privy Council. * The Court granted leave to appeal, provided the Public Trustee gives security and takes the necessary steps to. procure the preparation of the record and its dispatch to England.
