LAND FOR RAILWAY.
COMPENSATION ISSUE. (By Telegraph.—Press .Association.) WELLINGTON, Friday. Decision lias been reserved by the Full Court on a question arising out of the taking of land for the Tawa Flat(dcviation of the Wellington-Palmerston North railway. The claimants, Tawa Central, Limited, and Ella Hoare, both sought before a Compensation Court recently compensation in respect of land taken, and also for alleged injurious affection in respect of other lands belonging to tliqn. The construction of the deviation commenced in 1027, and by September, 1931, the date at which the value of the land taken had to bo ascertained, land in the vicinity of the deviation had greatly increased in value.
The respondent, the Minister of Public Works, contended that, in (ixing compensation, no account should \>e taken of such increase. The president of the Compensation Court tentatively ruled in favour of the claimants, and stated a case for the Full Court, which was asked to decide whether any of such value accrued to the lands as at September, 1931, was to be included or excluded for the purpose of assessing compensation.
If the president's ruling is upheld, Tawa Central, Limited, will be entitled to £2100, plus interest, and the other claimant to £400, plus interest. Should the Court decide in favour of the respondent, the compensation will be reduced to £805 and interest and £17.3 and interest respectively.
