THE NAYLOR CASE. APPLICATION TO COUKT DISMISSED. SYDNEY, May 31. Mr Justice Street, in the Equity Court to-day, dismissed Kufus Naylor's application for an interim injunction to restrain the Australian Jockey Club from acting under ite by-law No. 9, which empowers the club 1o exclude from its racecourse .persons within its discretion deemed to be undesirable. The judge said the wording of this by-law obviously was meant to apply to persons undesirable from the point _ot view of the management of horse racing on the Randwick racecourse as a sport. The Legislature had invested the club with power to make by-laws for the general management and control of the lands comprising the racecourse, and it was apparent that the Legislature intended that the club should have the right to say what class of persons should not enter the racecourse. , It was common knowledge, said his Honor, that undesirable persons attended racecourses for the purpose of earning a livelihood by various devioue and dishonest methods. Ho could not regard it as unreasonable that discretion should be conferred upon the committee of the club to exclude or expel such persons as it thought undesirable in the interests ot all concerned, particularly in regard to horse racing as a sport. However, the committee, before acting upon this by-law, should give the person involved an opportunity of being heard. Naylor's solicitor stated subsequently that an appeal against the decision will be lodged with the Full Court.
