NEGLIGENT DRIVING.
STOCK KILLED AND INJURED. TAURANGA, Thursday. In the Magistrate's Court, before Mr. F. W. Platts, S,M., L. T. K. Scahill was charged with negligently driving a motor lorry on the Tauranga-Te Puke main road on August 4, and, further, with driving a lorry which was not equipped with brakes complying with the regulations. Constable Skinner stated that a drover, W. J. Benner, was driving a mob of sheep from To Puke toward Tauranga on August 4. Near the Papamoa school a lorry driven by defendant ran into the sheep and kille'd a number of them. Defendant claimed that the speed of his lorry was not excessive.
After hearing further evidence the magistrate held that the defendant was negligent. On the charge of negligent driving he was lined £2, and for the brakes being out of order £1. He was also ordered to pay costs. Fred Davies was cliarged with negligently driving a trade motor on June 7 on the Tauranga-Waihi Road. Constable Skinner stated that Davies was driving a motor vehicle and ran into a mob of cattle on the road near the Judea saleyards, breaking the legs of two animals. The defendant was also injured and was removed to hospital.. After hearing evidence the magistrate said it was clear that the defendant had driven negligently. A fine of £2, with costs, was imposed.
