APPEAL ALLOWED.

HAMILTON, Friday.

Frederick Courtney, aged 52 years, successfully appealed in the Supreme Court to-day before Mr. Justice Herdman against his conviction for theft. Mr. Hall .Skelton appeared for Courtney* and Mr. Gillies represented the Crown. The appellant was convicted by Mr. F. W. Platts, S.M., in the Hamilton Police Court in August last, for stealing a pair of shoes from a shoe store and three bottles of oil from a petrol station. He was sentenced to three months' imprisonment on each charge. The appeal took the form of a rehearing. After hearing evidence his Honor said that although the circumstances in each case might be regarded v as highly suspicious, there was no evidence to connect the accused with the theft of the , articles. 1 The appeal was allowed.
