APPEALS DISMISSED.
Alleged "Frame-up" Assault On Jock Garden.
CONSPIRACY PLEA FAILS
SYDNEY, June 15. Four of the appeals by the eight men who -were convicted on the charge of assaulting Mr. J. S. Garden, secretary of the Trades Hall, on May 0, were heard to-day before Mr. Justice Curlewis. In the first case counsel sought to show that there had been a conspiracy on the part of certain people to cause the assault upon Mr. Garden for political motives, involving the New Guard. The judge dismissed the appeal, saying: "I am sorry I cannot increase the sentence of three months' imprisonment already imposed." Mr. Teeco, counsel for appellant, caused a sensation by remarking, "I am retiring from the case. I cannot sec any use in remaining." The junior counsel, Mr. Owen, remained. Subsequently the other three- appeals were dismissed. The remaining four were adjourned until to-morrow.
