INTOXICATION CHARGE.
FINE or «1O IMPOSED. COXFLICT OF EVIDENCE. On a charge of being in a state of intoxication while in charge of a motor car in Victoria Street at an early hour thie morning, Maurice Kalman (38), estate agent, was fined £10 by Mr. F. K. Hunt, S.M., at the Police Court. Defendant pleaded not guilty. Evidence was given by four police constables and a sergeant, all of whom considered Kalman was under the influence of liquor and unfit to drive his car. The defence was that Kalman vris sober. Counsel called a doctor who said that when he examined accused 8t the police station one hour and 25 minutes after his arrest, he was then quite sober, passing all teste. Counsel produced the certificate of another doctor that when he examined Kalman he was quite /sober. Three business men who spoke, to Kalman a few minutes before his arrest, stated in evidence that fce was fiober. In convicting Kalman, the magistrate said that a driver's judgment must not be impaired by liquor. He accepted the evidence as given by the police. However, he had not driven his car and the ca*e was not a bad one. Defendant's license was endorsed, but not cancelled.
