"IF YOU DIE."

TRANSPORT ACT ANOMALIES. COMMENT BY CHAIRMAN. TRANSFER OF LICENSES. (By Telegraph.—Own Correspondent.) GISBORNE, this day. "There are some very glaring anomalies in the Transport Act," commented Mr. F. B. Logan, chairman of tho District Licensing Authority at a sitting in Gisborne yesterday.

The remark was made to counsel, who applied on behalf of Mrs. Jean McGaveston for licenses on local runs. The applicant had purchased a run from an already licensed service owned by Mr. E. Salt.

"I believe you would be able to frame a bettor Act yourself," Mr. Logan said, "although I should not say so. I supposo if you have a motor service," the chairman went on, "and you die, there must be some goodwill in it. You must bo able to sell it, but I cannot see anything to this effect in the Act. Apparently when you die the license fizzles out and the whole of the goodwill you have in the concern 'goes West.*' "

Mr. Salt explained that he had already transferred his buses to the applicant, but he could not transfer the license.

The chairman pointed out that the licenses were in respect of particular vehicles and even if Mr. Salt desired to enter into competition with Mrs. McGaveston he could not use his present license, as it referred to vehicles which had been taken over by Mrs. McGaveston.

The secretary of the authority pointed out that the, correct procedure was to write to the Transport Department informing it that Mrs. McGaveston had bought Mr. Salt's buses and asking for the original license for the purchased vehicles. The applications by Mrs. McGaveston for new licenses on tho routes mentioned were granted.
