INTOXICATION CHARGE.
•WITHDRAWN BY POLICE,
SEQUEL TO FATAL ACCIDENT
A charge of being in a state of in
toxication while in charge of a motor car in Xew North Road on June 8, brought against Cyrus Lamson Smith, aged. 57, was withdrawn at the Police Court this morning.
~ls defendant was sent to the Supreme Court on a charge of negligently driving a motor car, causing the death of Henry Levitt Parker, the intoxication charge was adjourned until to-day.
Defendant was acquitted at the Supreme Court.
"In view of the decision at the Supreme Court, I have been instructed to withdraw this charge," said Detective Sergeant Kelly, to-day.
"I think you are quite right, he's been punished enough," remarked the magistrate, Mr. F. K. Hunt.
Mr. Singer, instructed by Mr. Kces, appeared for defendant.
