Judgment was reserved by Mr.-Jus-tice Blair in tlie Supreme Court yesterday in an application for a writ of mandamus to- compel the Minister of Customs to issue a- license for a distillery to be erected at ilahia, 16 miles south, of Auckland. The applicant was a Kaihere settler, George Smerle (Mr. Gould). "*'••- In concluding-his argument. Mr. Gould submitted that if tbe applicant were to erect buildings and instal plant "at bis periT' it would be liable to seizure and removal by Customs officers, without any remedy being open to the owners. He said: "Tlie statute cannot. be carried into effect without co-operation between the Minister and the applicant. That is the position in a nutshell."
