MOTOR CAR AT HAMILTON
FARMER SUCCEEDS IN CLAIM

Reserved judgment was given to-day by Mr. J. (J. L. Hewitt, S.M., in the case in which J. Graydcn, farmer, of Morriusvillc, sued the Farmers' Auctioneering Company for £200 damages in respect of alleged negligent and "faulty workmanship in repairing his motor car.
Plaintiff's evidence was to the effect that he took the car to the defendant company's garage for complete overhaul. On the day following its return, it was stated, the engine collapsed, and this he attributed to faulty workmanship. The defence was that the car was thoroughly overhauled, and that the breakdown was due to a flaw in the metal of the piston. It was held to be merely a coincidence that the collapse occurred when it did, and that it might have happened at any time, before or' after the overhaul.
Judgment was for plaintiff for'£lls, the magistrate holding that the overhaul and repair had not been satisfactorily carried out.
Defendant's counter-claim for £29 3/3 was not allowed.
