DAMAGE DONE TO MOTOR CAR. STRUCK UXLIGHTED TREE. (By Telegraph.—Own Correspondent.) PALMERSTON NORTH, Tuesday. W. J. Frew was to-day awarded £53 4/ damages and £8 3/ costs against the Borough Council on account of damage done to his motor car when it struck a tree in Cuba, Street on a dark and rainy night. The magistrate said that on a dark and rainy night the tree was a source of danger to the motoring public, and tliat the council had taken no reasonable steps to minimise the danger. The tree was unprotected, unlighted, and stood on a dark-surfaced road, and was practically invisible on a dark night. It was probable that, however alert the plaintiff had been, he would not have seen the tree in time to avoid a collision. Security for appeal was fixed at £20.
