Alleged Breach Of P_cr *~3 Suit Fails. EOXER AWARDED JUDGMENT. (Received 11 a.m.) BRIDGEPORT (Conn.), December 27. Gene' Tunney was awarded judgment in tlie suit brought by Mrs. Fogarty for alleged breach of promise. The action collapsed before the hearing. Mrs. Katherine King Fogarty, of Stamford, Connecticut, on May 21, filed notice of attachment on the home recently purchased in that city, by Gene Tunney, -ex-champion heavy-weight, boxer, in connection with her suit for breach of promise of marriage. Plaintiff claimed £100,000 damages. She said that Tunney'made a proposal of marriage in 1920, a week after she was divorced from John Fogarty.
