HER HUSBAND'S FRIEND.
MUSIC TEACHER'S CLAIM. AGAINST DECEASED'S ESTATE. | A claim for £387 3/6 against the estate of George William Irvine McEw'.in (deceased) came before his Honor Mr. Justice Smith at the Supreme Court this niornmg. The plaintiff was Maria Jane Roussel Cossey (Mr. Richmond, instructed by Mr. Quartley), and the defendant Sydney Broderick Jago (Mr. Reed), trustee for the estate of the deceased. Outlining the claim, Mr. Richmond said that plaintiff's husband and Me Ewin, when young men, had courted two sisters, and were extremely ' friendly. Mrs. Cossey "was a woman of some means, 'and a most successful music teacher. From time to time her husband mentioned to her that McEwin was in need of money, and she had advanced several loans to McEwin, the total amount being £157. Of this amount £20 had been repaid, leaving a balance owing of £137. Mrs. Cossey had also sold to McEwin an unencumbered section. The price was £250, but only £2 16/6 had been paid her. McEwin died on March 5 last, leaving estate worth £2000. Plaintiff gave evidence of the various loans and the dates upon which the amounts were advanced by her to McEwin. The latter had been in partnership with his brother in a hotel in Auckland, but later they dissolved, and McEwin went into partnership with Jago at Waihi. McEwin was not the kind of man. who would accept the money as a gift, and she was certain he intended to repay it.
