TWO COURT CASES.

DAMAGES CLAIMED.

A 6as& came before Mr.'E. 0. Cuttert, S.M., at the Magistrate's Court, in Which damages were claimed for injuries sustained owing to a collision between a motor Van and ft motor cycle in Great North Road* Grey Lynn, on July 13. Plaintiff, Alwyrt John McGregor (Mi\ L. Pi Leary); sought to recover from Eric & Puddle (Mr. E. W, Northcrbft) £109 1/, of which £75 was for general damages. The defendant is a cordial manufacturer, and his son was driving the motor Van.

Plaintiff stated he was going along the Gff eat North Road when the' van came out of King Street and the collision took place. Witness was knocked insensible and taken to the hospital. Some -Of his teeth were bfOk§ri. He also had abrasions on the face. Witness couid not work for three weeks. His wages were £4 8/ per week, fie was charged £4 4/ by the hospital. The repairs' t6 the cycle were estimated at £12; His teeth were damaged to the extent of £3. His hat was also damaged, which cost him about 30/*

The defence was that there was ample time for the plaintiff to cross without a collision occurring. Mr. Cutten reserved his decision^

PIrfAINTTFF NONSUITED. Mr. P. K. Hunt, S.M., heard a case at the Court in which J. L. Devlin (Mr: Miliken) sued H. Clowting (Mr. B. Hart) to recover £96 19/6, for damages alleged to have been sustained in a collision, his leg being fractured. Plaintiff was riding' a motor cycle down Albert Street into Qiiaj/- Street when a collision occurred wltH a lorry drivel by defendent.

The' defence' Was that the cycle was off side, and rah into the lorry.

Mf; Hunt said the real cause of the accident was that tlie plaintiff had to cross, the stream Of traffic at the foot of Albert Street,to get to his owri side of Quay Street. He failed to have regard to the approaching lorry* Plaintiff Was therefore nonsuited. Costs were allowed.
