WANTED A "COLD" CURE.

MAN BREAKS SHOP WINDOW.

T.TAWT.K UNDER NEW LAW?

CASE TO BE CONSIDERED

"The new section of the Mental Defectives Act seems to cover these men splendidly," said Mr. F. K. Hunt, SJH., in granting a remand in a case in which Garnett W. McMinn (46), labourer, was charged with smashing a window of a shop in Victoria Street.

The circumstances were unueual. McMinn had a cold, and in order to treat it, he wished to secure a bottle of a preparation which he saw in a window. He broke the glass and was inside among the bottles when the constable arrived. On a previous occasion, he had been going along the street on a Sunday afternoon when he came to a shop in which dogs were kept for sale. By breaking a window he liberated a number of them, and they frisked about the pavement.

Sub-Inspector McCarthy said the present charge showed a tendency on the part of McMinn towards acts of a peculiar character, and he asked for a remand of one day in order that the application of the Mental Defectives Act in such a case might be considered.

The magistrate agreed that there was a provision in the Act which appeared to meet the position, and granted the remand.
