DRESS CIRCLE CASE.
APPEAL BY BURNETT DISMISSED.
DEPOSIT OF £20 FORFEITED.

The racing conference judges heard the appeal by W. J. Burnett, owner of the horse Dress Circle, against the decision of the Auckland District Committee in disqualifying him for three years for corupt practices, and imposing a fine of £20 on him for employing an unlicensed trainer.
The secretary of the conference presented a telegram received from Messrs. Earl and Kent, solicitors, Auckland, reading as follows: "Burnett will not prosecute appeal. Asks that deposit be accepted in payment of fine."
The judges, being of the opinion that appellant should not at late stage be allowed to abandon his appeal on these terms, and no appearance being made by appellant, and having read evidence taken before the Auckland District Com mittee, and being satisfied there was ample material for the decision arrived at by that committee, have decided that the appeal should be dismissed, and tha' the £20 deposited by the appellant on lodging his appeal be forfeited.
