JURY'S VERDICT UPSET.
• JUDGE ORDERS NEW TRIAL. SEQUEL TO DAMAGES DECISION. The verdict of a jury in the Supreme Court which last month awarded a plaintiff £701 damages and costs is upset by the decision of Mr. Justice Herdman, whose judgment, received to-day, orders a new trial. Mr. Goldstine, counsel for plaintiff, states that he intends to appeal against his Honor's decision. The original action was one in which Robert James Wilson, carpenter (Mr. Goldstine), proceeded against George Kent and Sons, Limited, bakers (Mr. Dickson), for £1000 general damages, £273 for loss of wages, and £10 damages to a motor cycle. The hearing lasted two days, and after a retirement of nearly four hours the jury, by eleven to one, returned a verdict for plaintiff and assessed damages as follows: General damages, £250; special damages, £367 11/6, and three months' wages, £94, a total of £701 11/6. Judgment was entered accordingly, but Mr. Dickson was granted permission to move for a new trial. It was upon this application that his Honor to-day gave judgment.
