Thg §uprpme Court yesterday waa occupied "before Mr. Justice Reed, all day in the* hiring of an application by Forbes Finlay Gilmore "and his vyife, of Beach Road, Northcote, against the Mayor, councillors and inhabitants of Northcote Borough for an injunction in respect to their septic tank system. ' ' - The volume of" evidence, including that tti Wq medical men, Supported plaintiffs' oast —that most obnoxious fumes were exuded front the tanks and. vents, A number of Tvitnesses were called by the Council, who gave negative evidence that on certain occasions they had visited tip tank* and could, not cat«h the effluvia. Tha correspondence beween plaintiffs' splieitpr (Mr, Hall Skelton) and the Cpuncil \vas prcjducpd. , It was held by Mr. Hall SkeHpn that they had .tried to get the nuisance remedied, but only after proceedings had been taken was a distinct attempt made to effect a remedy, and this, only partially succeeded. Afr. for defendants, stated that the Council, cooperating with the Health Department, was endeavouring to effect a' permanent remedy. This morning a. conference was held between the parties, and, on Mr, Jqst'ce Reed's suggesting that the case might be adjourned, to enable the Council to abated the nuisance, Dr, Chegspn, Public Health • Officer, stated he wouid see that the nuisance was abated. His Honor "thereupon adjourned the case sine die, to be brought on with seven days' notice, stating that in the meantime the Council could effectually abate the nuisance, *
