FAMILY PROTECTION ACT.
A WIDOW'S APPLICATION. DECISION EESEBVED The case in whictf Mra. Elizabeth McCutcheon (Mr. Finlay) made an application under the Family Protection Act was concluded yesterday afternoon. Jit. Fitpieti; appeared for the Public and Mesrs Grould, Glaister, and Goulding for other legatees under the will of the late James McCutcheon. . \' r . ■ ' Mr. Finlay stated that since the testator had died difficulties; had arisen. Plaintiff's mother, who.liyed with her, lad'been allowed £l.a week by the testator. That had now to be provided by the plaintiff. The latter had no reserves S and felt that some provision should be made for her. The position was further complicated by the fact that the plaintiff had developed ill-health. There was £2,000 provided for a house, but there
■was no money available to furnish it. _Dr- Fitchett contended that the plaintiff Jiad an ample allowance, ghe received £250 a year as guardian of ■ the child. Counsel for the residuary, legatees offered no objection, ) i»e . His. Honor stated that' thY plaintiff should receive a. cash payment and her income should be increased. The whole of the estate, with the exception of £5000 set apart for the child eventually went to qhaftty. He would reserve his decision. .
