(Br Telegraph.—Press Association.* WELLINGTON, this day. An interesting legal point was decided by the Arbitration Court in the case Angus McLagan. coahniner. and the Blackball Coal Company. Plain tiff ?laimed under section a of the Workers" Compensation Act. 1922. fl for surgical attendance on him in respect of an injury sustained by him while in the service of the de lend ant company. ""Til* action wa* in the nature of a test one." said Judge Frazer, "for the navinent or -surgical or first-aid sxpenses was nearly always ia dispute when a miner was injured. Court ijave judgment for the defendant eompanv. holding that pjaintifr nad not brought himself within the sections oi the Act. for no liability for an ascertained sum had been incurred by him or the Medical Club for surgical attendance in respect of tbe particular injury suffered by him.
