DISPUTE OVER CONTRACT.
PERCENTAGE BASIS DENIED. A TAKAPUXA BUILDING. A claim fora lien for £189 on a property in Hauraki Road, Takapuna, where Herbert Meyriek, contractor (Mr. Jacobsen), had converted a building into flats was made against Joseph and Sarah Ehrman (Mr. Leary), before Mr. F. K. Hunt, S.M., at the Magistrate's Court to-day. The work was clone by plaintiff at the request of .the defendants, and plaintiff put in an account on the basis of a ten per cent, arrangement, which brought the total cost of the building to between £05(i and £700. Defendants alleged that it had been a hard and fast contract for £4.50 and £51 for extras ordered. They also alleged that all the materials in the invoices had not l>een used in the house and submitted the evidence of architects in support of this. In giving judgment the magistrate said he thought that the more probable story was that there was a ten per cent, contract, but that the material before the court was insufficient for him to decide the exact amount owing. He suggested that the matter be adjourned sine die and full particulars submitted for the consideration of the architects concerned, who would thus be enabled tc check them and arrive at a fair figure. The dispute was accordingly adjourned sine die for this to be "-one into. " ———————^___
