STBXTCK WHILE BEING TOWED. ST. HELIER*S ROAD INCIDENT. ' Who or what was' responsible for a collision on the St. Helier's Road on May 29 between a car -was being towed, and a motor : lorry traveling in. the opposite direction.?, was a question which Mr. F. K. Hunt, SjM., was asked, to solve at the Magistrate's Court thia morning. Thomas ]Jrederick Young (Mr. Sexton), . bus driver,. was the plaintiff, and John McXaughton (Mr: West), carrier, the defendant. Young claimed special damages, £32 for repairs to his car and general damages for the loss of the car, etc., while it was disabled. (Plaintiff, in evidence, staged that he was being towed from St. Heller's and had arrived at the rise near Remnera. terminus, when defendant's lorry, coming in the opposite direction, just missed the towing-car and struck the one behind, severely damaging it. Plaintiff used the car as a taxi and was having it towed in to have a damaged chassis welded. Sir. West: Do I gather from your account of the conversation that you i suggest McSfaughton admitted liability and offered to make good the damage? Witness: I don't suggest it. I say definitely he did! The driver of the car, which was towing, stated that at the time of the collision he told' McXaughton that he was on the wrong, side of the road and pointed out the wheelmarks. ■"I am surprised," said Mr. Hunt, 'that you and your friend say that the car was struck as a result of the lorry being on the wrong side of the road, and yet you had no argument about it." "Well the accident had occurred, it was of no use rowing," replied witness. Sxr Hunt: Well, if anybody ran into mc I should have something to say. (The case ie proceeding.)
