•'«'- T-ECAL POFNTS RAISED, f Further evidence was given to-day before Mr. Justice Cooper and a jury at the Supreme Court in the claim for £300 damages, and for special damages, by Ernest Edwards, fruiterer, Auckland (Mr. Hall -Jkelton) against Joseph Wilkins, Mount Albert (Mr. A. 5. Skelton). The claim was founded upon an alleged breach of a lease of property in Mount Albert, containing an option to the plaintiff to purchase.

HLs Honor noted three grounds upon which Mr. A. E. Skelton moved for 4 nonsuit. These -were:—iftl) That t'.e contract did not satisfy the Statute of Fraud-; (_•) that if it was held to be .sufficient then there was no evidence of any breach, because the evidence did not. prove that a sale had been effected over the plaintiff's head; and (3) that plaintiff had not complied with the conditions of the covenant". The legal points were reserved, and the defendant gave evidence. The case is proceeding.
