A CLAIM FOR £320. A civil action, the Oversea Sales ;ency Ltd., of Auckland, v. James Neil, d., manufacturing chemists, Dunedin, claim for £320 in respect of a ship;nt of soda ash, was part heard by r. Justice Cooper at the Supreme Court -day. Dr. Bamford appeared for the aintifls, and Mr. Adams, of Dunedin, r the defendant*. The plaintiffs allege that in July, 191S, a defendants bought from them 20 tons soda ash. that the ash was shipped om San Francisco and arrived at Wellgton the following December, being forwards transhipped to Dunedin. The fendants, they asserted, wrongfully resed to accept the ash and pay for it, iving purported to cancel the order ! .'o months before. The ash was re-sold! a loss of £314, which sum, with some) Iditions, the plaintiffs claimed. The defence denies that the ash actu-1 ly shipped was the ash ordered, orl iat it was in accordance with the ■ntract, in quality or otherwise.
