The only case down for hearing ;it the criminal sitting of the Supreme Court this morning, before Mr. Justice Chapman, was the charge against Albert David Prosser accused of having on March 111 last, at Kllerslie. caused actual no,lily harm to a lad under such circumstances that had death ensued he would have been guilty of manslaughter. The cireumstanes are that on the date in question a body of cadets was drilling on-the roadway, and it is aileg-ed that Prosser. driving a motor cycle with a side-car attached, ran into the cadets, knocking one of them down, and breaking his leg. The case came on for hearing at the last session of the Supreme Court, but was adjourned because Prospers wife, who w.-is an important witness for the defence, was in Australia. Later Prosser himself also had to proceed to Australia, where his father was in a dying condition, this visit being made with the sanction of the Court. When (he case was called this morning Mr. 11. A Singer, who appeared for I'rosser, explained that his client had experienced a great deal of difficulty iv getting away from Australia. Filially he had secured a passage by the l-'.ssex, which should have sailed from Sydney a fortnight ago last Saturday, the steamer did not, however, get away till the following Saturday, and only arrived at Wellington at daylight Inst Friday. I'rosscr had telegraphed him to say he would reach Auckland 10-day, and assuming thai he caught Friday's' tram from \Vellington he could reach Auckland from Taumarunui to-night.
