MAGISTRATE'S COURT.
HATVKES VERSUS FIELD. The defended ease in Which A. T. Hawkes, of Auckland, land claimed from E. T. Field, solicitor, Auckland, the sum- of iis on an account for which the defendant gave an I.O.I"., was resumed at the S.iSL Court tills morning before Sir. F. K. (Hunt. Sir. A. Si. Slowlem appeared for the plaintiff, and Mr. Field appeared on his own behalf.
Six. Field confessed the stun of fTS, and costs £-, but counter-claimed, lor the flam of £200, on account of stock transactions. In the counter-claim, Mr. Field asked £11 for feeding, and taking caTe of horses during a portion of the year. He further stated that liawkes had ottered him 113 head ol cattle ut £7 15/ per head; -that, in order to Induce him to purchase the sai» cattle, it was represented there were at least 00 dairy cows and heifers to come in during the spring of IMS, whereas only seven of the cows and heifers came In dnrtng the said period, and only 25 up to thft date of the issue of tbis counter-claim: TUus. as dry stork, they were worth a good d;al leas than they would have been In profit. After "hearing the evidence, Mr. Hnat gave judgment for the plaintiff on the first claim, and disallowed the counterclaim, with costs to the defen-Ivnt. — «
