COMPENSATION CLAIM.
JUDGMENT FOR DEFENCE. The Arbitration Court haa filed its decision upon the compensation claim made by James Nasey, a labourer employed by the Public Works Department, against the Crown, in respect to an alleged injury. The plaintiff alleged that a disability from which he suffered was caused by a blow received in the course of his work, though he admitted that he did not notify his superiors of the fact at the time, but continued to work for a fortnight or more. The Crown denied that the trouble which subsequently developed was due. to the blow, and sag. gested another cause. The Court held that the Crown was not precluded from contesting the claim by the fact that Xasey had been given half-pay for a period. It found that the onus was on Nasey to show that the cause of his trouble was due to an accident in the course of his employment, and that such an accident did occur. This, in the Court's opinion, he had failed to do. Judgment was given for the defendant, without costs. Mr. R. McVeagh, instructed by Mr. J. J. Sullivan, appeared for the plaintiff, and ilon. J. A. Tole K.C., for the Crown.
