The bearing of the evidence concluded 'yesterday in the action brought at the '.Supreme Court, to decide a trusteeship 'between R. W. .Dyer and others and Andrew Hanna, solicitor, of Auckland, jMr Brown appeared for the plaintiff-, and iMr Reed, K.C., and Mr Anderson for the defendant. The action arose over a sum of £9.500, which it was alleged had been received by the defendant as compensation for land taken by the City Oouncil in connection with the Anzac Avenue scheme. The plaintiffs claimed that they were the proper parties, ns executors of : the will of Colonel Shepherd, deceased, ito distribute the moneys. The defence 'set up that the whole of the moneys received by the defendant had already been distributed amongst the beneficiaries, and denied the right of the plaintiffs to interfere is tiir. sdministration. The ad-dresses of counsel are to be heard on Monday week.
