TROUBLE OVER A WILL.
A SUPREME COURT CASE. £25,933 LEFT TO A CHURCH. His Honor the Chief Justice heard further argument in the Supreme Court at Wellington on Friday in respect to the will of the late Andrew Casey, settler, of Hamilton, concerning which an originating summons had been brought under the provisions of the Families' Protection Act. Under the ; will deceased widow had been , granted an annuity of £3 par ; week, along with life interest in the ; homestead and other property. The will provided oleo that the eldest child . should receive £ 1,000, and a £1,550 debt contracted by the second son would be . forgiven. Each of the other ten children , was given sums of either £200 or £300. ; Tho remainder of the estate, of a total value of £25,933, was left to the Catholic . 'Church. Application was now made for ' better provision for the widow and ten . children. ; Sir John Findlay, K.C., with Mr D. R. ' Hoggard, appeared for the widow and ! children of deceased; Mr E. P. Hay for , the Public Trustee (executor of the will); and Mr C. P. Skerrett, K.C., for the Church. Sir John Findlay said that the Church , had agreed to an increase in the widow's annuity providing for an allowance ot £4 a week, also that she should receive in cash £800. This was satisfactory to j the widow. It now remained for the . court to decide as to the children's shares. Judgment was reserved.
