XHB TAKAPTJNA SETTLEMENT. •COUNTY AND BOROUGH STILL AT LOGGERHEADS. Despite the fact that the award of the Commission which inquired into the settlement of affairs between the Waitemata County Council and the Takapuna Borough Council has been filed, friction end misunderstanding still appears to exist between the two bodies, judging by-a discussion which took place at las"t Bight's meeting of the last-named authority. Arising out of a letter from the •Department of Internal Affaire intimating the nature of the final settlement, ■the borough e-olicitor (Mr W. G. McGregor) attended the meeting and explained that, in spite of several applications, he had been unable to obtain the 6um of £510 vhipii thp Co in mission ruled was payable by the County Council tp the iiorough as the ''ash balance to wind up the settlement. The Council therefore had the right to sue for the money. The county clerk, stated Mr MeGTegor, fully admitted that the amount was due. and declared that he had the cheque ready signed, bnt he wae advised by the county authorities' solicitors tha-t he should not hand over the cheque until the Borou-ih Council had signed the deed of indemnity provided for by the award. He immediately explained that the Council was prepared to at once attest its sisnature, but-the trouble was the deed had not been prepared by the County Council, legally the Council wai entitled to interest on the sum as from the date of the award, February 16th. and morally from the date on which the agreement .was arrived at. The County Council had been generously treated by the. Mayor and member* of the connnittpe winch dealt with the matter, and the delay | iwae a shabby return. ' j Mr E. E. Grimwade observed that as | the borough had bpen so patient with; the Waitemsta County Council—the settlement was now spread over years—and as a full month had elapsed since the date of the award, action should be taken to obtain the inonpy. He mured that notice be given to the Waitemata County Council to pay within seven days, in default a writ to be iseiied. the Council claiming interest from February 16th. This was seconded by Mr T. Hanna. and carried unanimously.
