A case which recently came before the Magistrate's Court in Christehurch revealed a rather peculiar position SI between the police and persons committing a breach of the Indecent Publications Act. Sections 43, 44, and 45 of the Police Offences Act, 1908, dealt with offensive publications, section 45 giving the police power to arrest without warrant a person committifcg an offence under sections 43 and 44. The Indecent Publications Act of 1910 repealed that portion of the Police Offences Act dealing with indecent publications, and the pome have no longer power to arrest, or to commence any prosecution, without the leave of the Attorney-General. & oilier words, a police officer may catch* man red-handed exhibiting or selling indecent pictures or cards, but be unable to take any action until the AttorneyGeneral has been consulted. Where an offender would be by the tune » consultation was concluded is one- « the problems the police have not yet solved. Much as the beautiful weather n»y be enjoyed iby residents in the city, some of the farmers in the Waikato are 'beginning to feel anxious.
