In the course of a judgment on a claim for commission arising out of an exchange of properties, Mr. Bailey, S.M., said the general trend, of the law was to discourage persons'acting as agents for both parties to the transaction, and the agent could not receive commission from both parties. In the case of exchange, persons might claim to be the agent for the two vendors, but there would be conflicting interests, and the principle must be maintained that the agent could not act for both parties without the fullest disclosure and consent of the parties. The onus lay on the agent to prove such disclosure and consent.
