Plaintiff claims that he made an agreement with Asher to take five per cent of the team's gate money, and to divide the commission with Asher, for the latter's. part in completing the arrangements. Asher, in a letter, alleges that he offered Jack 2i per cent of the team's share of the first gate, but never agreed to. pay commission. . .
