Defended Case.—Austin Walsh and Co. v. Tonson Garlick Co.:' In this action the plaintiffs sought for payment for a certain time register or for the return of same. Mr A. Hanna appeared for the plaintiffs, and Mr F. E. Baume for the defence. The defence was that defendants did not recognise the plaintiffs in the action, and that they had an agreement with a Mr Smellie to supply furniture in return for the register. This register was supplied. Mr Baume said the question was which of two innocent parties was to suffer. This morning His Worship gave judgment for plaintiffs for the re.urn'of the macbine.
