CRIMINAL SITTINGS

(Before His Honor Mr. Justice Conolly.)

A SALUTAEY. SENTENCE

Samuel Patrick Moody, indicted that on October 1, 1890, nt Opotiki, he indecently assaulted May Gordon, a child under the age of 10, was found guilty by the jury after we went to press yesterday. The Crown Prosecutor, in giving an outline of the case, stated that the girl had been staying with the prisoner and her aunt, who were living to-o-ether at Opotiki as man arid wile. On the night of the 7th October, 189 a, the aunt had a disagreement with prisoner, and left the house. It was on this night the assault was committed. The girl subsequently had a child. After the prisoner was arrested he married the aunt. Mr. Campbell* for the defence, argued that the indictment was bad, but His Honor overruled the objection. His Honor, in sentencing prisoner, , said that it was a very bad case, and he imposed a sentence of two yeara, with hard labour. RECEIVING STOLEN PROPERTY. Joseph Braslin pleaded gtiilty to receiving stolen property, which had been robbed from a dwelling at Epsom on May 29. Mr O'Meagher appeared for prisoner. His Honor deferred sentence pending the hearing of a charge of perjury a<>-ainSt'prisoner. ALLEGED THEFT OP HEIFERS. The Court was occupied tluring the whole of to-day re-hearing the charge against- William Henry Palmer of having, on May 10 last, at Tataranki, stolen two heifers, the property of W. H. Bradley. - Prisoner pleaded not guilty. He was defended by Mr N. A. McLeod. Mr Tole conducted the case for the Crown. The case was heard on Saturday and Monday last, but the jury failed to agree on a verdict, hence the re-hear-ing to-day. The defence is that the two heifers belonged to. the accused himself.
