ALLEGED MURDER.

DUNEDIN, February 23

Hearing of the charge of the murder Of his wife on New Year's morning against Thomas Callovray was continued at the Supreme Court to-day. The Crown Prosecutor, in opening the ease, repeated his theory, which he admitted sustained a charge of manslaughter only. The theory was that accused, when in bed, was violently assaulted by his wife because she could get no more chlorodyne, and that accused, losing his self-control, retaliated and struck her fatal blows with a tomahawk, the head of which was afterwards found concealed under the bed. The evidence of neighbours and police was the same as at the inquest. The neighbours' statements all indicated the excellent conduct and a long suffering disposition of accused, and that husband and wife lived in

amity, except Avhen the wife became excited at not having chlorodyne. Accused was found not guilty and was discharged.

The police arrested at Carr's Creek, a Chinaman named Loc Nee, charged with the murder of another Chinaman named Loe Soy, at Goat Flat, Hutt Creek, on or about February 2.1. When his statement was being taken, the accused struck for the bush, but was recaptured, and remanded till March 6.
